1. Who these terms apply to

These Terms of Service ("Terms") form a binding contract between you (the customer or visitor) and Bunny Honey Club SRL, a Romanian limited liability company registered at the Romanian National Trade Register Office, operating the online store Warm Shelf at warmshelf.com.

By accessing or placing an order through Warm Shelf, you agree to these Terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old (or the age of majority in your country) and have legal capacity to enter into binding contracts to place an order.

3. Products and pricing

Warm Shelf is a curated online retailer of home decor (lighting, vases, wall decor, sculptures, trays, and related items). We do not manufacture our products in-house — we curate from selected international design and manufacturing partners, and act as the EU Responsible Person under Regulation (EU) 2023/988 (General Product Safety Regulation) for all products sold to EU customers.

All product prices are displayed in your local currency at checkout (USD, GBP, EUR, AUD, CAD, NZD where supported). Prices include applicable taxes for EU customers as required by EU law. For customers outside the EU, prices are exclusive of import duties, taxes, and customs fees, which are the recipient's responsibility (see our Shipping Policy).

We reserve the right to correct pricing errors and to refuse or cancel any order based on inaccurate pricing information, even after the order has been submitted.

4. Orders and acceptance

Submitting an order is an offer by you to purchase. We accept your offer when we send the order confirmation email and dispatch the product. If we are unable to fulfil your order (e.g. stock unavailability), we will notify you and refund any payment made.

5. Payment

We accept the payment methods displayed at checkout (Shopify Payments, major credit cards, PayPal, Apple Pay, Google Pay, and others depending on your region). Payment is collected at the time of order placement. Bunny Honey Club SRL is the merchant of record.

6. Shipping and delivery

Shipping terms, processing times, transit times, fulfilment regions, and customs information are described in our Shipping Policy, which is incorporated into these Terms.

Risk of loss passes to you upon delivery to the address you provided at checkout.

7. Returns, refunds, and EU cooling-off rights

Our full return and refund procedures, including the EU 14-day unconditional cooling-off right for distance contracts, are described in our Refund Policy, which is incorporated into these Terms.

8. Consumer rights and statutory warranties

Nothing in these Terms limits or excludes any non-waivable statutory rights you have as a consumer under applicable law, including:

For EU customers: 2-year legal warranty against defects under Directive (EU) 2019/771, and 14-day unconditional cooling-off period under Directive 2011/83/EU
For UK customers: the Consumer Rights Act 2015
For US customers: applicable state consumer protection statutes
For Australian customers: Australian Consumer Law guarantees under the Competition and Consumer Act 2010
For New Zealand customers: Consumer Guarantees Act 1993
For Canadian customers: applicable provincial consumer protection statutes

9. Intellectual property

All content on warmshelf.com — including text, photography, product imagery, brand identity, design elements, and code — is the property of Bunny Honey Club SRL or our licensors and is protected by Romanian, EU, and international copyright and trademark law. You may not reproduce, redistribute, or commercialize any content without our prior written consent. Personal, non-commercial browsing and shopping use is permitted.

10. Acceptable use

You agree not to:

Use the site for any unlawful purpose
Attempt to access non-public areas of the site or our infrastructure
Interfere with the operation of the site (denial of service, malicious code, etc.)
Scrape, harvest, or systematically collect data from the site without our written consent
Impersonate any person or entity

11. Disclaimer of warranties (where permitted by law)

Except for the statutory warranties referenced in Section 8, the site and the services are provided "as is" without express or implied warranties beyond those required by law. We do not warrant that the site will be uninterrupted or error-free, or that products will exactly match the colour or appearance displayed on your screen due to monitor variation.

12. Limitation of liability (where permitted by law)

To the extent permitted by applicable law, our total liability to you arising out of any order or use of the site shall not exceed the amount you paid for the relevant order. We are not liable for indirect, consequential, or incidental damages. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Indemnification (where permitted by law)

You agree to indemnify Bunny Honey Club SRL against claims arising from your violation of these Terms, your misuse of the site, or your infringement of any third party's rights, to the extent such indemnification is permitted under applicable consumer protection law.

14. Governing law and dispute resolution

These Terms are governed by the laws of Romania, without prejudice to mandatory consumer protection provisions of the country where you reside as a consumer.

For EU consumers, the European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are willing to participate in alternative dispute resolution but are not legally obliged to do so.

EU consumers may bring legal proceedings in the courts of their country of residence or in Romanian courts. For non-EU customers, disputes are subject to the courts of Bucharest, Romania, without limiting any non-waivable consumer rights you have in your country of residence.

15. Changes to these Terms

We may amend these Terms from time to time. Material changes will be communicated via the homepage and/or by email. Continued use of the site after changes constitutes acceptance of the revised Terms.
